7. Disclaimer of Warranties

To the fullest extent permitted by Dutch law, the Website and all Content are provided "as is" and "as available" without any warranties of any kind, whether express, implied, or statutory. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and uninterrupted availability.

We do not warrant that the Website will be free of errors, viruses, or other harmful components, that any defects will be corrected, or that the Website will be continuously available. We do not guarantee the reliability of any information obtained through the Website.

Our total aggregate liability for all claims arising from or related to these Terms or your use of the Website shall not exceed the greater of: (a) the total amount you have paid to Carton Bottles B.V. in the twelve (12) months preceding the claim, or (b) one hundred euros (€100).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under Dutch law.

11. International Use

The Website is operated from the Netherlands. We make no representation that the Content is appropriate, available, or legally permissible for use in all jurisdictions. If you access the Website from outside the Netherlands, you do so at your own initiative and are responsible for compliance with applicable local laws.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law provisions. Any disputes arising from or in connection with these Terms or your use of the Website shall be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.

If you are a consumer resident in the European Union, you retain any rights available to you under the mandatory consumer protection legislation of your country of residence. Nothing in these Terms affects your statutory consumer rights under applicable EU or member state law.

13. Dispute Resolution

Before initiating any formal legal proceedings, we encourage you to contact us at [email protected] to attempt to resolve any dispute informally. We will make good-faith efforts to resolve the matter within thirty (30) days of receiving your written notice. EU-resident consumers may also seek recourse through their national courts if they prefer.

14. Termination

We may suspend or terminate your access to the Website, in whole or in part, at any time and for any reason, including but not limited to violations of these Terms, without prior notice or liability. Upon termination, your right to use the Website will cease immediately.

15. Severability

If any provision of these Terms is found by a competent court or authority to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

18. No Waiver

Our failure to enforce any right or provision of these Terms at any time shall not constitute a waiver of that right or provision. Any waiver of a breach shall not constitute a waiver of any subsequent breach. The exercise or non-exercise of any remedy shall not preclude the exercise of that or any other remedy.

19. Modifications to These Terms

We reserve the right to modify these Terms at any time. Material changes will be announced via a notice on the Website at least fourteen (14) days before taking effect.
